Resolved Question: How can I stop a checking account garnishment when I have filed for bankruptcy?

I live in Michigan & recently went through a divorce, foreclosure, and was laid off at work. For the past year, I have been unemployed & then am currently temping. My ex-husband declared bankruptcy and basically, our second mortgage wasn't foreclosed on (it was a different bank than the first mortgage) and that entire balance is now my responsibility. It's over $35,000. I was served last summer and then in Feb 2009 my MI State Income Tax refund was garnished. Now, I received a writ of garnishment from the court and it was sent to me FROM my old credit union. THEY were served with papers on 6-18-09 and thankgod, the account was CLOSED so they could not pull money from the account. I am fearful that now, they will get to my CURRENT bank & possibly my staffing company where I work. I checked my current bank acct. and there is still a positive balance but what should I do? Close this account? NOTE: I secured a bankruptcy attorney and paid in full within the first week. I was given a first draft and returned that to them over 3 weeks ago. I am awaiting a SECOND draft. It has not yet been filed with the courts. Am I not protected yet? Any advice would be appreciated. Thanks in advance more

Voting Question: Sheriff's sale is cancelled in Wayne county Michigan, what happens to my house?

My sheriff's sale was scheduled in Feb. But our county sheriff stopped foreclosure sales before the sale, I have not heard anything after that. I tried to contact my bank, but no response. Does anyone know what is going on? I am scared that they could throw my stuff out of my house before giving me any notice. Is it possible? Or they have to give me some sort of notice before they take any action?SINCE THE SHERIFF'S SALE WAS CANCELLED IN THE WHOLE COUNTY, I IMAGINE MY HOUSE WAS NOT IN THE AUCTION WHICH MEANS THE REDEMPTION PERIOD HAS NOT STARTED??? more

On news.yahoo.com a few days ago: "Students in Virginia, Colorado and South Carolina were wrongfully told by voting officials that they could lose their scholarships and their parents would no longer be able to claim them on their income taxes if they registered to vote in their college towns. The Michigan Department of Civil Rights launched an advertising campaign this week to combat misleading rumors - some started by local officials in mailings to voters - that people would be denied the right to vote if they lost their home to foreclosure, have a criminal record or do not have photo identification." Does anyone have first hand experience of what's going on? more

Resolved Question: Is my wife liable for my rental foreclosure?

My wife and I got married last November, and at the time I was living at my duplex, renting out one side and living in the other. Since then I've moved in with her and have rented out the other side as well. I was getting market value for the one side until the tenant stopped paying (that's a whole different story), the other side I'm renting out at below market rates, considering we're talking about Oakland County, Michigan. I lost my job within the last year and we've struggled to make both of our mortgages...she works for her father's company and is secure from a job perspective. She is however worried that the mortgage holder will hold her liable also, not just me, if this leads to foreclosure...which we're attempting to stop at all costs. So the question is who's liable for the mortgage on my duplex, it's in my name and only my name...she has nothing to do with it, besides being married to me...any help would be much appreciated. Democrats Sue Michigan G.O.P. on Voter Issue By Michael Falcone Updated Responding to allegations that Republican Party officials in Macomb County, Michigan plan to use home foreclosure lists to challenge voters at the polls in November, the Obama Campaign and the Democratic National Committee filed a lawsuit on Tuesday in federal court to prevent what they contended was an illegal practice. Obama Campaign General Counsel Bob Bauer said that using home foreclosure lists as a basis for challenging voter eligibility would have a “deadly effect of the voting process” and argued that the practice would be illegal. “This is a standard operating procedure within the Republican party that’s been under legal challenge,” Mr. Bauer said on a conference call with reporters on Tuesday. Last week the chairman of the G.O.P. in Macomb County, James Carabelli, was quoted in the online publican, the Michigan Messenger, as saying that the party planned to use foreclosure lists to stop voters who no longer have valid addresses from casting their ballots. “We will have a list of foreclosed homes and will make sure people aren’t voting from those addresses,” Mr. Carabelli was quoted as saying, according to a Sept. 10 article in the Michigan Messenger. Since the story first appeared, Mr. Carabelli has repeatedly denied that the party planned to use the lists, and in an interview with The New York Times suggested that he was misquoted. “I have no voter challenging program here in my county,” Mr. Carabelli said late last week. And in a statement on the Michigan G.O.P. Web site the chairman of the Michigan Republican Party Saul Anuzis called the story “a complete fabrication.” “There has never been a plan to use foreclosure lists to challenge voters. There is no such plan, and there never will be such a plan. Period,” Mr. Anuzis said. Mr. Anuzis repeated those assertions on a conference call today and said that the Republicans would formally ask the Messenger for a retraction. Absent that, he said, the G.O.P. would pursue a libel lawsuit against the publication. According to a statement on its Web site, Messenger editors appeared to be resisting calls for a retraction. “There will be no retraction because Mr. Carabelli and Mr. Anuzis’ claims are unfounded. The quotes were not fabricated. Michigan Messenger and the Center for Independent Media stand behind this story 100 percent.” Mr. Anuzis characterized the Democrats’ legal action a “stunt.” “It clearly shows their desperation as they move forward,” he said. But the Obama campaign countered that the denials amounted to “backpedaling” on the part of the Michigan G.O.P., and said that they had enough evidence to go forward with the lawsuit. “Our position is very simply, they can tell it to the judge,” Mr. Bauer said. Resolved Question: How long after you stop making your house payments until you get kicked out?

A friend of mine lives in Michigan and told me they stopped making thier house payments 4 months ago and the bank hasn't even started the foreclosure. They also tell me that once they get the notice they have 6-8 months before they actually have to vacate the house. Is that true? Can they really live there for free for a year? more

We stopped payment on our mortgages and credit cards in December per lawyers suggestion. Our house is not in foreclosure yet but they call 3x's a day. I have not hired a lawyer frankly because I can't find one I am satisfied with. Have been to 7. Each one tells me something different and I would like straight answers. Here are my questions. 1. How long after filing bankruptcy can you stay in your house legally before they force you out? I'm in Michigan. 2. How long before a Sheriff sale sign gets put on your door do you have until they force you out? Basically I want to know what my options are in regards to filing chapter 7. I want to stay in the house the maximum amount of time. I also do not want to be sued by any creditors in the mean time. I'm sensing a catch 22 here. I own a Michigan home with a mortgage and needed repairs that I can't afford. I put my house for sale, but it hasn't sold for over a year because most people here in Southeast Michigan can't afford to buy a home, and no one wants one with problems. I want to move out of state (Missouri) into an apartment, but I can't afford rent and a mortgage. If I leave my house and stop making payments, it obviously goes into foreclosure, but what are all of my consequences if I don't pay the mortgagee anything? The house gets repossessed, but then what? The mortage that I'm paying is much higher than the value of the house, so my equity is gone. There is no benefit to owning it or living in it, so I just don't want the responsibility of the house anymore. Please advise options. more

Resolved Question: Double mortage foreclosure in Michigan, I need an expert!?

I need someone who has a little knowledge regarding mortgage foreclosure- we're going to see a lawyer in the next few days, but we're a little nervous, so any knowledge for a little piece of mind would be a huge help! My fiancé' has a house with a $150G mortgage, and a second mortgage of $60G debt consolidation. Unfortunately, he made some business investments that went wrong (basically he got F*). The $60G is money that someone owes him that he will never get back. Michigan economy is going from bad to worse. We tried to sell his house. We did a lot of work and now it's gorgeous, but we can't get anyone in to see it. Even so, the most the house will sell for is $175G. That leaves $35G gap. It's getting bad for us. It has been suggested that we just foreclose. Sounds good and all (We know it ruins the credit-got that covered), but two big questions: Can we foreclose on both mortgage without them repossessing anything and in that case, do we stop paying property tax as well? HELP! more

My mother-in-law informed my husband and I that she is losing her house. I'll give you the info she gaves us and maybe someone can tell us what can be done? A little over a year ago the home was refinanced (the second time in a little over 5 years) for the full purchase price and equity (a total of a little over 120 grand). She claims that she made a payment plan with the mortgage company (cant say how true that is) and went yesterday to make the first payment according to the plan. The mortgage company told her that in essance it was too late and that the home was/will be auctioned Thursday. Apparently it has been in the paper for this auction for the last month (we knew nothing of this). The mortgage company also told her that she would have to pay $4,000 to stop the auction sale. So if she doesn't come up with this money and the home is sold at auction, how long does she have to stay in the home? Can she try and sell it herself?? Is there still a chance to save the house? more
